A suit against Ichilov Hospital and the Health Ministry was filed Monday at the Herzliya Magistrates Court in which it was claimed that Zipora Rahimi 44 died due to medical negligence during a heart bypass operation at the hospital in March 1997
According to the suit while the patients chest was opened the surgeons saw penetrated her hearts right ventricle and caused a major rupture and blood loss
The operation was carried out by Dr Amir Kremer and after a complication was also partly attended by Professor Rafi Mor then acting director for the heart surgery department at Ichilov 
Professor Mor is today deputy director of the of the department headed by Professor Gideon Oretzky
The lawsuit submitted by attorneys Danny Srur and Doron Caspi is based on the professional opinion of heart surgeon Dr Eli Milglater from Hadassah University Hospital Ein Karem in Jerusalem and states that the surgery took 11 hours and only toward the end of the procedure Professor Mor informed that patients family that during the opening of the chest the surgeon penetrated the right ventricle with the a saw rupturing the heart and causing a great deal of bleeding
Most of the operation they were busy stopping the bleeding
Dr Milglater said that despite the fact that the operation was on a highrisk patient who underwent similar surgery 10 weeks earlier a young specialist and a junior doctor were designated to perform the operation
He added that no vital and crucial procedures were carried out during the surgery to decrease the risks in such a difficult operation
A committee of inquiry that investigated the case stated in 2000 that there no element of negligence was found in the medical procedures carried out on the patient
However in May 2000 Professor Shlomo Laniado who was then the director of the cardiology department testified before the commission that he had told Rahimis family that they should sue and reach a settlement deal
