Please note that the EEOC's vague "hostile work environment" standard has been narrowed by Supreme Court decisions to give free speech some protection. Of course, when I say that application of the standard in the workplace is acceptable, I mean the narrowed version. Our real concern is with application of the vague and broad standard outside of the workplace. If, as Scott assures me, the standard will not be applied outside of the workplace, then the ACLU has no objection. If it is applied outside of the workplace, then the concerns expressed in my November 29 letter are pertinent. A more narrowly tailored and specific policy to combat sexual harassment should be enacted. My letter to CMU suggests one possible approach. I apologize if the letter created confusion.
